These Terms of Service (“Terms”) govern your access to and use of the products, services, events, designs, and experiences provided by TheUltimateGiftQuest (“TheUltimateGiftQuest”, “we”, “us”, or “our”), including our website, custom treasure-hunt experiences, hosted events, physical builds, and related materials (collectively, the “Services”).
By visiting our website, submitting an inquiry, booking an experience, or paying an invoice, you agree to be bound by these Terms.
If you are booking on behalf of a group, company, or family, you represent that you are authorized to accept these Terms on their behalf.
1. What We Do
TheUltimateGiftQuest creates custom, story-based treasure-hunt experiences and related materials, which may include:

Custom puzzles, challenges, props, and storylines

Themed environments, decor, and staging
-
Time capsules, letters, keepsakes, and family-history elements
-
Actor-led “living puzzles” and live scenes
-
Hosted and/or partially hosted experiences in homes, offices, or other venues
The specific details of your Quest (scope, date, location, price, and deliverables) will be set out in your booking confirmation, proposal, or invoice (each an “Order”).
2. Bookings, Payments, Refunds & Cancellations
Because our experiences are highly custom-built and require significant design time, materials, and scheduling of talent, the following policies apply:
Refunds Within 48 Hours
You may request a full refund within 48 hours of your initial payment for an Order. If you cancel within this 48-hour window, we will refund the amount you have paid for that Order, unless a different policy is clearly stated in writing for a specific promotion or agreement.
Cancellations After 48 Hours & Cancellation Fees
After the 48-hour refund window has passed, refunds are no longer guaranteed. Cancellations may be subject to cancellation fees based on how far we are in the design and build process for your Quest, including:

Time already spent on custom design and planning

Materials ordered, customized, or produced for your Quest

Reserved talent, venues, or third-party services that cannot be recovered
Any partial refund, if available, will reflect the work completed and costs incurred up to the time of cancellation. Once your Quest reaches certain stages of production, some or all amounts paid may become non-refundable because the work and materials cannot be repurposed for other clients.
Payment Schedule
We may require an initial payment or deposit to reserve your date and begin design work. Remaining balances are due on or before the date specified in your Order. If payment is not received by the due date, we may pause work or cancel the experience.
Rescheduling
We will use reasonable efforts to reschedule if you request a new date with sufficient notice. Rescheduling is not guaranteed and may be subject to:

Availability on the new date

Additional costs or fees, especially if materials, talent, or venues must be rebooked or adjusted
Chargebacks
By booking, you agree not to initiate chargebacks or similar payment disputes for Services that were started, delivered, or significantly worked on, except in clear cases of payment fraud.
3. Changes, Scope & Last-Minute Requests
Scope Defined by the Order
Your Quest is designed based on the scope, budget, and theme in your approved Order. Requests to add or change features (extra puzzles, props, scenes, actors, locations, or complexity) after approval may require additional fees and extra time.
Last-Minute Changes
We are not obligated to accept last-minute changes or additions. If we do accept them, you acknowledge that:

Timelines may shift,
-
Certain elements may be simplified or adjusted, and
-
Additional charges may apply.
Timelines & Delays
Any dates and timelines we give are good-faith estimates, not guarantees of delivery at an exact hour or in an exact form.
We are not responsible for delays caused by:

Late approvals, incomplete information, or lack of feedback from you,
-
Venue issues or access restrictions,
-
Third-party vendors, or
-
Events outside our reasonable control (see Section 11, Force Majeure).
Our obligation is to use reasonable efforts to deliver the agreed experience as close as possible to the planned date and design.
4. Safety, Behavior & Protection of Actors and Staff
We design experiences that feel intense, cinematic, and exciting, but they must remain safe and respectful for everyone involved.
Respectful Conduct Toward Actors and Staff
You agree that you and your guests will treat all actors and staff with respect and basic safety. Harassment, threats, unwanted physical contact, hate speech, or any abusive behavior toward actors or staff is strictly prohibited.
Right to Pause or End an Event
We reserve the right, in our sole discretion, to pause or end the experience and/or remove any participant who behaves in a way that is unsafe, threatening, or offensive. No refunds will be given if we end an event early due to guest misconduct.
Responsibility for Your Guests
If you book the event, you are responsible for the behavior of your guests. You agree to indemnify and hold us harmless from any claims, damages, or costs related to your guests’ conduct, including any damage to the venue, our props/equipment, or claims involving interactions with our actors or staff.
Actor Conduct
We expect our actors and staff to behave professionally and respectfully at all times. If there is any concern about actor or staff conduct, please inform us during or after the event so we can address it. To the extent permitted by law, any liability relating to actor or staff conduct is limited as described in Section 9 (Disclaimers & Limitations of Liability).
5. Venues, Third Parties & Your Space
Your Venue Responsibilities
If the Quest is hosted at a location provided by you (e.g., home, office, or rented venue), you are responsible for:

Securing all necessary permissions and approvals,
-
Compliance with venue rules, occupancy limits, and safety requirements, and
-
Any venue fees, deposits, or penalties.
Third-Party Vendors
We may recommend or coordinate with caterers, photographers, videographers, or other vendors, but they operate independently. We are not responsible for the acts or omissions of third-party vendors.
Damage to Property
You are responsible for any damage to venue property or to our props, equipment, or materials caused by you or your guests. We may invoice you for the reasonable cost to repair or replace damaged items.
6. Intellectual Property & How You Can Use Your Quest
Many parts of your Quest are custom created for you, and we want you to be able to fully enjoy them.
What’s Yours
All physical items we leave with you as part of your Quest—such as time capsules, letters, keepsake props, printed materials, and any custom artwork of you, your family, or your group—are yours to keep. You are free to replay your Quest, share it with family and friends, add to it over time, and make personal adjustments for non-commercial use.
What We Still Own
We retain ownership of our underlying creative systems and brand, including:

TheUltimateGiftQuest name, logo, and branding;

Our general puzzle mechanics and design methods;
-
Story structures, formats, and templates we reuse across experiences; and
-
Any digital frameworks or tools we use to build Quests.
This allows us to continue creating new Quests for other clients while you enjoy yours.
Personal Use vs. Commercial Use
In simple terms: if we leave it with you, you can enjoy it in your life; you just cannot turn it into a business or product. You agree that you will not, without our written permission:

Sell or resell your Quest, or charge tickets for others to play it as a commercial product or service;

Package our designs, puzzles, or materials as your own “experience,” “kit,” or service for sale;
-
Use our brand name, logo, or marketing materials to promote your own services.
Content You Provide
Any personal content you provide (such as letters, photos, family stories, or other materials) remains your property. You grant us a limited license to use that content only as reasonably needed to design, build, and deliver your Quest.
7. Photos, Video & Marketing
You can choose whether you allow us to use images or footage from your event.
If you give permission (for example, by checking a box, signing a photo release, or agreeing in writing), you grant us the right to use photos, short video clips, and testimonials from your Quest for our portfolio, website, and marketing materials.
If you do not give permission, we will not use images from your event publicly, except as required by law or to protect our legal rights.
You and your guests are welcome to take photos and videos for personal use and sharing (for example, on social media), provided you do not present our work as your own commercial product or service.
8. Website Use & Online Content
By using our website, you agree that you will:

Not attempt to hack, disrupt, or interfere with the website’s operation;

Not scrape or copy large portions of the site for commercial purposes;

Not misrepresent your identity when submitting inquiries, forms, or bookings.
9. Disclaimers & Limitations of Liability
No Guaranteed Emotional or Relationship Outcome
We design Quests to be meaningful, exciting, and connection-building, but we cannot guarantee specific emotional or relationship outcomes (for example, resolving long-term conflicts or guaranteeing particular reactions).
“As-Is” Services
To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
Limitation of Liability
To the fullest extent permitted by law, our total liability for any claims arising out of or relating to the Services is limited to the amount you paid us for the specific Quest or Order giving rise to the claim.
We are not liable for:
-
Indirect, incidental, special, or consequential damages;
-
Lost profits, lost opportunities, or loss of goodwill;
-
Delays or disruptions caused by factors outside our reasonable control.
Assumption of Risk
By participating, you and your guests understand and accept the inherent risks of interactive experiences, including moving around your chosen space, interacting with props, and engaging in light suspense or “thrill” elements if included.
You are responsible for informing us of any major accessibility needs, medical limitations, allergies, or strong triggers you want us to avoid, and for selecting an environment appropriate to your group.
10. Indemnification
You agree to indemnify, defend, and hold harmless TheUltimateGiftQuest, its owners, employees, actors, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your breach of these Terms;

The conduct of you or your guests at an event;

Damage to property or injuries caused by your group’s actions;

Unauthorized commercial use of our intellectual property or brand.
11. Force Majeure
We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to: severe weather, natural disasters, power failures, government actions, public health emergencies, strikes, or major third-party failures.
If such an event occurs, we will work with you in good faith to reschedule or adjust your Quest. Refunds and cancellations remain subject to the refund and cancellation policy in Section 2, except where prohibited by law.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules.
Any dispute arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in [Your County], Georgia, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page.
If you continue to use the website or book new Services after we post changes, you agree to the updated Terms.

15. Delivery & Shipping
All physical Quest packages and related orders include free delivery.
Orders delivered within the State of Georgia typically arrive within 1–2 business days once they have been shipped. Delivery times for orders outside Georgia may vary based on location and the shipping carrier.
All delivery timeframes are estimates and may be affected by carrier delays, weather, or other factors outside our control. Our obligation is to ship in a reasonable timeframe and to provide you with tracking or status information where available.
